AN ACT relating to misclassification of employees.

This bill would create legal protections for workers who are incorrectly labeled as independent contractors when they should legally be considered employees. It adds clear definitions of "independent contractor" and "misclassified" to state law, and gives workers a way to seek a remedy if they have been misclassified. Misclassification can affect a worker's access to benefits, wage protections, and other employment rights. Who it may affect: Kentucky workers classified as independent contractors, employers who hire contract workers, and gig or marketplace workers.
